DANIA BEACH - A woman from Palm Beach County is suing a man, the company he is employed by, and the president of that company for four counts of auto negligence.
The Plaintiff, Elaine Fine, filed a complaint on September 7, 2016 in the 17th Judicial Court against Anthony Young, Tate Transport Corporation, and Robert Chris Tate alleging Young negligently operated a vehicle owned by his employer, Tate Transport Corp., and the president of that company, Robert Tate, with permission and consent, causing a collision with the motor vehicle operated by Elaine.
According to the complaint, on September 11, 2012, the Defendant, Young, negligently operated and/or maintained a dump truck owned by his employers with permission and knowledge. Due to his negligence, the truck collided with Elaine's motor vehicle causing her injuries including, but not limited to; pain and suffering, lost wages, and loss of ability to care for herself. she will suffer these losses in the future.
On the first count, Young is found negligent for failing to operate and/or maintain a motor vehicle in a safe and reasonable manner, causing a collision. On the second, third, and fourth counts, Tate and Tate Transport Corp. are found vicariously liable for the negligence of their employees, including Young.
The Plaintiff requests a trial by jury of all issues and demands judgment against Anthony Young, Robert Chris Tate, and Tate Transport Corporation for compensatory damages in excess of $15,000.00, costs, interests, and attorney fees. She is represented by Alan E. Brady, Esq. ofBrady and Witters, P.A. in Ft. Lauderdale.
