FORT LAUDERDALE - On November 22, 2016, the Plaintiff in a negligence action filed a complaint against Broward County and City of Fort Lauderdale, alleging they were responsible for a fall incident.
According to the complaint, on October 2, 2013, the Plaintiff was walking on the sidewalk near 199 NW 29th Avenue in the city of Fort Lauderdale. The Plaintiff was walking along the sidewalk where he stepped into a hole around an area that was under construction by the city. The Plaintiff states the city of Fort Lauderdal and Broward County had been negligent by allowing the area remain in dangerous condition and constitute a hidden trap. The area had no warning devices of any kind near and around the site of injury to the Plaintiff, which would have cautioned him of dangerous condition.
The Plaintiff is alleging that the Defendant is responsible for the injury sustained by the Plaintiff. As a result of the negligence of the city of Fort Lauderdale and Broward County, the Plaintiff has suffered injury in and about her body and extremities and/or aggravated pre-exisiting conditions. The negligence by the Defendant has led to the Plaintiff suffering from but not limited to pain, physical handicap, lost wages, and the inability to lead a normal life. The losses are either permanent or continuing and will result in future losses for the Plaintiff.
The Plaintiffs demand judgment against the Defendant for damages in excess of $15,000, plus costs, and demands a trial by jury. Additionally, the Plaintiffs are represented by Richard Perlini, Esq. of Richard Perlini, P.A. in Fort Lauderdale.
